Hey guys! It’s me again!
I’m having some trouble getting money together to pay my last rent bill here in Japan, so it’s time for me to sell off an item that’s very precious to me :’( - But I’m hoping it’ll go to someone who really cares for it!

Listed is the Fire Emblem 3DS Console Bundle /WITH/ game. This 3DS is a Japanese console so it will play all of those awesome Japanese import games you may want to try playing! It also comes with the Fire Emblem: Awakening game in Japanese for you to either play like a pro or practice your Japanese with!

Sorry but:

1. Etsy is the store who’s floor space you are renting. Therefore they have the right to deny you service.

2. Their rules are laid out clearly here: http://www.etsy.com/help/article/483 and speak about items needing to be handmade as well as why things will be flagged.

3. They explicitly state that they conversation to fix these issue should be private, by publicizing the issue you are not solving your problem but making it worse.

You can cry all you want, but Etsy is in the right. They should reinstate your shop since you meet their requirements; but they aren’t required too.

And? Just because a website isn’t required to provide anyone service doesn’t mean people shouldn’t publicize shitty service stories, especially when the website in question is a business. The only reason why Etsy would even ask that the conversations remain private is as a cheap way to avoid PR nightmares - e.g. we can screw you over and you can’t talk about it, or we’ll have a legitimate breach of regulations and then be excused in screwing you over. Catch 22 type situation, damned if you do and damned if you don’t.

The staff at Burger King is not under the obligation to sell me burgers, but if they refuse and then give me bullshit reasons as to why they won’t sell me burgers, you can be sure as hell I’ll share the story, even if they are within their right to deny me service and try to silence me with bullshit confidentiality clauses.

Actually it’s very heavily implied that Morgan is from a different timeline than the other children, which means that if one of the 2nd gen characters is Morgan’s father or mother, Morgan did not exist in their original timeline.

Leaving the above clipped so this doesn’t get very long, but I also noticed they take PagSeguro for payments. Here’s the English version of their website: https://pagseguro.uol.com.br/en/what-is-pagseguro.html (you should be able to contact them in English or Portuguese).

Their ToS does have a clause against intellectual property theft:

“z) produtos que infrinjam direitos de autor, marcas, patentes, modelos e desenhos industriais, segredos comerciais ou industriais, domínios de internet, nomes comerciais ou qualquer outro direito de propriedade intelectual em qualquer país;”

z) products that infringe upon copyrights, trademarks, patents, models and industrial drawings, commercial or industrial secrets, internet domains, commercial names or any other intellectual property rights in any country.

It’s definitely worth a shot to contact PagSeguro with complaints of IP theft. PS is like PayPal in Brazil, so getting their account shut down would send a message, at the very least.

Think we’re able to at least get the site bad rep? If we can’t make our law handle it… we make them lose profits? Just an idea, because… shit, this whole situation is disgusting.

Yeah, a smear campaign could help, but it’d be… difficult to get people around here to care. Still, leaving a torrent of comments in their Facebook and sending lots of complaints to their hosting service can’t hurt.

I haven’t been able to get this down, despite 2 different people contacting them for me asking them to take it down. They said they would, yet, 2 weeks later, it’s still up. Do you guys think you can leave a barrage of comments that I did not give permission for that to be used, and ask for them to take the shirt down until they do??? I don’t really know what else to do at this point since I’ve tried nicely to get this resolved quietly but they’re just not listening.

I speak Portuguese/am Brazilian so I should be able to help with translating.

However, your chances of success at getting it taken down are… slim. Being in a different country makes pressing legal charges difficult and even if you were able to sue them, the legal system in Brazil is sluggish and outdated, and it could take years (and by then the shop wouldn’t even be up anymore). Meaning, they have no reason whatsoever to fear legal repercussions.

I know of someone who was Brazilian and living in the US who had their art stolen and printed on shirts of a large local chain store and I remember he had a lot of trouble getting anything done about it even with access to local lawyers.

I did notice their store uses a hosting service called superdominios.org - they have a contact e-mail for abuse at abuse@superdominios.org which you could try as an alternative method (let them know the store in question is stealing material for their products, see if you can get the host itself to remove the page). Their website is in Portuguese though. They also apparently have a chat support system that works from 8 AM until midnight Brazil time (GMT -3). I could not find their terms of use, sadly, so contacting them may be fruitless too, but it’s worth a shot.

Edit: I checked out the store some more and they are very very shameless about their theft - I don’t think talking to them will resolve anything. From their about page:

Which means they just admit they’re using shit they found on the internet, ergo all of their shirts are stolen.

This is an otome game blog so this giveaway is otome game themed only.

First winner will get a fullbody dakimakura-themed drawing of their favourite otome game guy. Also! It’ll also be offered in strip game form.
